TERMS & CONDITIONS

The owner of the online store beawarecup.ee (hereinafter referred to as the "Online Store") is Be Aware Cup OÜ (registration code 16534198), located at Aasa tee 5b, Püünsi village, Viimsi parish, Harju County, Estonia.

Validity of the Sales Agreement, Product and Pricing Information 

These Terms & Conditions apply to all purchases made through the Online Store.

The prices of products sold in the Online Store are displayed next to each product. Delivery fees are added to the product price. All prices displayed in the Online Store are in euros (€).

The delivery fee depends on the buyer's location and chosen delivery method. The applicable delivery fee is displayed during checkout. 

Product information is provided directly next to each product in the Online Store.

Placing an order

To place an order, the buyer must add the desired products to the shopping cart, choose a suitable delivery method, and complete the required information fields. The total amount payable will then be displayed on the screen and can be paid securely using the following payment methods:

  • Estonian bank payments: Swedbank, SEB, Luminor, LHV, Revolut
  • Latvian bank payments: Swedbank, SEB, Luminor, LHV, Revolut
  • Lithuanian bank payments: Swedbank, SEB, Luminor, LHV, Revolut

Payments are processed by Montonio Finance UAB (registration code 3050205122), a company registered in the Republic of Lithuania, which provides payment initiation services to the Online Store in accordance with its Terms of Service. 

By making a payment, the customer confirms acceptance of Montonio Finance UAB's payment terms, available at Montonio Terms of Service.

Payments are processed outside the Online Store in the secure payment environment of Montonio Finance UAB. The Online Store does not have access to the customer's bank or credit card details. Montonio Finance UAB does not have direct access to the customer's funds while providing the service.

The sales agreement enters into force once the payable amount has been received in the Online Store's bank account.

If the ordered goods cannot be delivered due to the product being out of stock or for any other reason, the buyer will be informed as soon as possible and all payments made (including the delivery costs) will be refunded to the same bank account without delay, but no later than within 14 days of notification.

Processing of Personal Data and Direct Marketing

The Owner of the Online Store, Be Aware Cup OÜ (registration code 16534198, Aasa tee 5b, Püünsi village, Viimsi parish, Harju County, Estonia), acts as the controller of personal data.

For the purpose of fulfilling orders, the Online Store transfers the personal data necessary for payment processing to the authorised processor Montonio Finance UAB and the data necessary for delivery to the selected shipping service provider. 

The Online Store uses the buyer's personal data solely for processing orders, delivering products, and fulfilling obligations arising from applicable legislation. More detailed information regarding the processing of personal data can be found in our Privacy Policy.

The Online Store sends newsletters and promotional offers only if the buyer has given explicit consent by entering their email address and confirming their wish to receive direct marketing communications.

The buyer may unsubscribe from direct marketing communications at any time by clicking the "Unsubscribe" link included at the bottom of newsletters or by contacting us at info@beawarecup.ee.

Delivery

The Online Store ships products to the following countries:

  • Estonia
  • Latvia
  • Lithuania

Products are delivered via SmartPosti OÜ parcel machines or other selected delivery service providers.

Shipping costs are borne by the buyer and are displayed during checkout next to the selected delivery method.

Orders within Estonia generally arrive within 1-3 business days from the entry into force of the sales agreement. Deliveries outside Estonia (Latvia and Lithuania) generally arrive within 3-7 business days.

In exceptional circumstances (including high order volumes, holidays or delivery delays), delivery may take up to 45 calendar days.

Right of withdrawal

After receiving the order, the consumer has the right to withdraw from the sales agreement concluded in the Online Store within 14 days without providing a reason.

The right of withdrawal does not apply if the buyer is a legal entity.

To return a product, the consumer must submit a withdrawal request and send it to info@beawarecup.ee no later than 14-days after receiving the goods. In the request, the buyer must include the order number and the information necessary for processing the refund.

The buyer bears the direct cost of returning the goods unless the reason for the return is that the returned product does not correspond to the order (e.g., incorrect or defective product).

To exercise the 14-day return right, the product may only be used to the extent necessary to verify its nature, characteristics, and functionality in the same way that would be permitted in a physical store.

If the product has been used beyond what is necessary for inspection or shows signs of use or wear, the Online Store reserves the right to reduce the refundable amount according to the decrease in the product's value.

The buyer must return the goods within 14 days of submitting the withdrawal request or provide proof that the goods have been handed over to the carrier within that period.

Upon receiving the returned goods, the Online Store will refund all payments received from the buyer under the contract without undue delay and no later than within 14 days of receiving the withdrawal request. Refunds will be made to the same bank account used for the original payment.

The Online Store may withhold the refund until the returned goods have been received or until the buyer has provided proof of return shipment, whichever occurs first.

If the buyer has explicitly chosen a delivery method more expensive than the standard delivery option offered by the Online Store, the Online Store is not required to refund the additional delivery cost.

The Online Store reserves the right to withdraw from the sales agreement and request the return of the goods if the product price was displayed incorrectly due to a technical error and was significantly below the market price. 

Right to file a Complaint

The Online Store is liable for any non-conformity or defects in the goods sold to the buyer that existed at the time of delivery and become apparent within two years from the delivery of the goods to the buyer.

It is presumed, that any lack of conformity that becomes apparent within one year from the delivery of the goods existed at the time of delivery, unless such presumption is inconsistent with the nature of the goods or the defect. The burden of proving otherwise rests with the Online Store.

If a defect appears, the buyer has the right to contact the Online Store within two months by sending an e-mail to beawarecup@gmail.com or by calling: + 372 555 123 23.

The Online Store is not responsible for defects that have arisen after the delivery of the goods due to the buyer's actions, improper use, inadequate maintenance, or normal wear and tear.

If the goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Online Store will refund all fees associated with the sales agreement to the buyer.

The Online Store will respond to consumer complaints in writing or in a format that can be reproduced in writing within 14 days.

Dispute resolution

If the buyer has any complaints regarding the Online Store or the goods, they should contact the Online Store by email at beawarecup@gmail.com or by phone at + 372 555 123 23.

If the buyer and the Online Store are unable to resolve the dispute through negotiations, the buyer has the right to contact the Consumer Disputes Committee.

The Consumer Disputes Committee is authorised to resolve disputes arising from agreements concluded between the buyer and the Online Store. 

Reviweing the buyer's complaint by the committee is free of charge.
